Samyang Foods has successfully secured domestic trademark rights for “Buldak,” its iconic spicy noodle brand. This significant legal victory grants the company a stronger foundation to combat the proliferation of counterfeit products and unauthorized imitations globally, marking a pivotal moment for the brand previously deemed too generic for exclusive ownership.
Following a challenge-free 30-day objection period, the Ministry of Intellectual Property officially approved the registrations for both the English-language “Buldak” and its Korean counterpart on Tuesday. This crucial trademark protection extends to “Buldak” in English for both noodles and sauces, while the Korean-language mark specifically covers noodle products, fortifying Samyang’s intellectual property portfolio.
This approval culminates a prolonged struggle spanning many years, originating in 2008. Samyang Foods initially faced setbacks in securing trademark protection for “Buldak,” which translates to “fire chicken” in Korean. Authorities at the time considered it a common descriptive term, unsuitable for exclusive brand ownership. A subsequent application in 2023 also did not achieve success.
Samyang’s renewed determination was driven by a significant evolution in consumer perception. Over the years since the launch of its globally popular fiery noodles, “Buldak” has transitioned from a generic category descriptor into a distinct and powerful brand identity. This growing association unfortunately also made the brand increasingly attractive to unauthorized imitators seeking to capitalize on its success.
Earlier in January, Samyang Foods Chair Kim Jung-soo underscored the formidable challenges of protecting Korean brands internationally during a government economic forum. She revealed the company was actively engaged in trademark disputes across 27 countries, even while holding official registrations in 88 different markets worldwide.
Indeed, numerous look-alike products and counterfeit spicy noodles have emerged in diverse markets, including China, Southeast Asia, the Middle East, and Eastern Europe. These unauthorized imitations frequently misuse the “Buldak” name, despite having no legitimate connection or affiliation with the renowned Korean food manufacturer.
This critical trademark registration is poised to significantly bolster Samyang’s broader intellectual property enforcement strategies. It will empower intensified anti-counterfeiting initiatives across global online marketplaces and customs checkpoints, and strengthen their efforts to oppose unauthorized Buldak trademark registrations in international territories.
