LG Electronics USA Inc. has reached a critical settlement in a privacy lawsuit initiated by the Texas Attorney General’s office. The lawsuit alleged that LG’s smart TVs collected sensitive user viewing data without obtaining proper consent, sparking significant concerns about consumer privacy and data security in the digital home.
Under the terms of this pivotal settlement, LG Electronics USA Inc. is now mandated to secure explicit user consent before collecting any viewing data via its automated content recognition (ACR) technology. Furthermore, LG smart TVs will feature a prominent pop-up disclosure, clearly explaining the methods of data collection and usage, alongside providing users with an unambiguous option to opt out of such practices, reinforcing data privacy controls for homeowners.
A crucial stipulation of the agreement explicitly prohibits LG from transferring any collected viewing data to the Chinese Communist Party, addressing a major concern about potential foreign surveillance. Importantly, LG did not admit liability or wrongdoing as part of this comprehensive settlement.
Texas Attorney General Ken Paxton emphasized that this landmark settlement is fundamentally designed to safeguard consumers from potential unlawful surveillance within the privacy of their own homes, particularly through smart TV technologies.
“LG has now taken important steps to ensure that users’ viewing data will not be collected without their informed consent and that consumers maintain their fundamental right to privacy in their own homes,” stated Attorney General Paxton. He further asserted, “No electronics company should be collecting consumers’ data and exposing Texans to potential surveillance by the Chinese government.” Paxton expressed satisfaction that following his office’s action, smart TV companies are implementing necessary measures to protect Texans. He pledged continued aggressive efforts to hold other smart TV companies accountable for unlawfully utilizing ACR technology, which places consumers at risk.
LG Electronics USA affirmed its commitment to prioritizing consumer privacy, stating it collaborated with the state to enhance what it described as its established practice of securing consumer consent prior to any smart TV data collection. This reinforces their dedication to user data protection.
This settlement stems from a broader lawsuit filed last year by the Texas Attorney General against LG and four other prominent TV manufacturers. The suit alleged these companies were secretly tracking Texans’ viewing habits and other personal data via their smart TVs, raising widespread privacy concerns.
Notably, Samsung Electronics America previously reached a similar privacy settlement with Attorney General Paxton in February. Meanwhile, legal cases against Sony, TCL, and Hisense—the three remaining companies implicated in the original smart TV privacy lawsuit—are still pending resolution.
