It has been announced that all nine members of the idol group The Boyz have successfully secured a court decision to grant their injunction, suspending the validity of their exclusive contract with agency One Hundred Label.
On the 23rd, Attorney Kim Moon-hee, legal representative for The Boyz, stated, “The court has decided to grant The Boyz’s application for an injunction to suspend the validity of their exclusive contract. Accordingly, we confirm that through the court’s judgment, The Boyz have received confirmation that their exclusive contract with One Hundred Label (One Hundred) has been lawfully terminated and its effect has ceased.” She added, “The court recognized that One Hundred violated its obligation to pay settlement fees, failed to provide settlement data to verify the appropriateness of the settlements, and moreover, did not fulfill key obligations under the exclusive contract, such as management support and artist protection. Considering these circumstances, the court concluded that the trust relationship between the parties has irreparably broken down due to One Hundred’s fault.”
Attorney Kim Moon-hee further explained, “One Hundred has claimed in the media and during the injunction proceedings that the contract deposit had the nature of an ‘advance payment,’ but the court explicitly rejected this. The court clarified that the payment of the contract deposit and the distribution of settlement fees based on profit generation are stipulated as separate clauses in the exclusive contract, and there is no agreement stating that the already paid contract deposit can substitute for new settlement fees that should be paid to The Boyz.”
She continued, “The court made it clear that the contract deposit is distinctly separate from settlement fees, as it was a payment made specifically to The Boyz at the time of signing the exclusive contract, recognizing their significant popularity and recognition. This contract deposit, offered by One Hundred to secure The Boyz, reflected their current and future value and marketability, leading to the exclusive contract based on mutual agreement. Therefore, One Hundred’s current attempt to distort the size or nature of The Boyz’s contract deposit is merely an effort to reverse or deny its own prior judgment and decision.”
Attorney Kim Moon-hee added, “The Boyz will responsibly and faithfully fulfill schedules already confirmed before the exclusive contract termination, honoring their promises to fans and minimizing harm to good-faith third parties. Despite the difficult circumstances, with the agency’s false claims and public opinion battle ongoing, The Boyz have dedicated themselves to daily practice, diligently preparing for their concerts, and have gone above and beyond, even bearing significant personal costs. Most importantly, they feel immense excitement and responsibility at the thought of meeting their fans soon and accept the court’s clear resolution of the exclusive contract dispute with both gravity and gratitude.”
◆ Full Official Statement from Attorney Kim Moon-hee of Yulchon LLC
Hello. This is Attorney Kim Moon-hee from Yulchon LLC.
On behalf of The Boyz’s Sangyeon, Jacob, Younghoon, Hyunjae, Juyeon, Kevin, Q, Sunwoo, and Eric (hereinafter referred to as “the Artists”), we are issuing an official statement regarding the decision to grant the injunction for the suspension of their exclusive contract.
Today, the court decided to grant the Artists’ application for an injunction to suspend the validity of their exclusive contract. Accordingly, we announce that the Artists have confirmed, through the court’s judgment, that their exclusive contract with One Hundred Label Co., Ltd. (hereinafter referred to as “the Agency”) has been lawfully terminated and its effect has ceased.
The court recognized that the Agency violated its obligation to pay settlement fees, failed to provide settlement data to verify the appropriateness of the settlements, and moreover, did not fulfill key obligations under the exclusive contract, such as management support and artist protection. Considering these circumstances, the court concluded that the trust relationship between the parties has irreparably broken down due to the Agency’s fault.
The Agency had previously claimed in the media and during the injunction proceedings that the contract deposit had the nature of an “advance payment,” but the court explicitly rejected this. The court clarified that the payment of the contract deposit and the distribution of settlement fees based on profit generation are stipulated as separate clauses in the exclusive contract, and there is no agreement stating that the already paid contract deposit can substitute for new settlement fees that should be paid to the Artists. Furthermore, it was made clear that the contract deposit is distinctly separate from settlement fees, as it was a payment made specifically to the Artists at the time of signing the exclusive contract, recognizing their significant popularity and recognition. This contract deposit, offered by the Agency to secure the Artists, reflected their current and future value and marketability, leading to the exclusive contract based on mutual agreement. Therefore, the Agency’s current attempt to distort the size or nature of the Artists’ contract deposit is merely an effort to reverse or deny its own prior judgment and decision.
As previously stated in their official position, the Artists will responsibly and faithfully fulfill schedules already confirmed before the exclusive contract termination, honoring their promises to fans and minimizing harm to good-faith third parties. Despite the difficult circumstances, with the Agency’s false claims and public opinion battle ongoing, the Artists have dedicated themselves to daily practice, diligently preparing for their concerts, and have gone above and beyond, even bearing significant personal costs. Most importantly, they feel immense excitement and responsibility at the thought of meeting their fans soon and accept the court’s clear resolution of the exclusive contract dispute with both gravity and gratitude.
The Artists are apologetic for any fatigue caused by unnecessary noise during the separation process with their Agency. However, they hope that future follow-up procedures will be resolved more smoothly and swiftly. The Artists will continue to do their best in their activities alongside their fans. We ask for your continued interest, support, and warm encouragement. Thank you.
